Terms of Service

The terms that govern your use of Elevate Stats.

These Terms of Service ("Terms") govern your use of Elevate Stats, including the marketing site at elevatestats.app (the "Site") and the Elevate Stats application at app.elevatestats.app (the "App"). Elevate Stats is provided by Elevate Sports Labs Inc. ("Elevate Sports Labs," "we," "us," or "our"), a company incorporated in the Province of Ontario, Canada.

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

Elevate Stats is a software application that helps coaches, team staff, and parents track statistics for amateur hockey teams. Features include game tracking, roster management, player and opponent records, shot tracking, and AI-generated insights.

We may add, change, or remove features from time to time. We will try to give reasonable notice of material changes, but we do not guarantee the continued availability of any specific feature.

2. Your Account

2.1 Eligibility

You must be at least 16 years old to create an account. By signing up, you confirm that you meet this minimum age and that the information you provide is accurate.

2.2 Account Security

You are responsible for:

Keeping your login credentials confidential.
All activity that happens under your account.
Notifying us promptly at privacy@elevatesportslabs.com if you suspect unauthorized access.

We are not liable for any loss or damage arising from your failure to protect your account.

2.3 One Account Per User

You may not share your account with others or allow another person to use your credentials. Future versions of the App may offer shared team access through invitations — when available, those invitations will be the supported way to give others access.

3. Information You Enter

3.1 Your Data

You retain ownership of the team, roster, game, and event data you enter into the App ("Your Data"). By using the App, you grant Elevate Sports Labs a limited licence to host, store, process, back up, and display Your Data for the purpose of providing the App to you, and to generate AI Insights as described in our Privacy Policy.

3.2 Information About Minors

Amateur hockey teams often include minors. When you enter information about a minor (such as a player's name, jersey number, or on-ice statistics), you confirm that:

You have the authority to enter that information, whether as the player's coach, team manager, parent, or legal guardian, or because you have obtained appropriate consent.
You will use Elevate Stats only for legitimate team and player development purposes.
You will not share the App or its content in a way that violates the privacy or safety of any minor.

You are solely responsible for ensuring that your use of the App complies with any team, league, or local rules about collecting and handling player information.

3.3 Accuracy

You are responsible for the accuracy of Your Data. We do not review, verify, or correct the information you enter.

4. Acceptable Use

When you use the App, you agree not to:

Use the App for any unlawful purpose or in violation of any applicable law.
Enter information about another person (including a minor) without the authority to do so.
Attempt to access, probe, or scan any part of the App or its infrastructure outside of normal use.
Reverse engineer, decompile, or try to extract the source code of the App.
Use automated scripts, bots, or scrapers to interact with the App.
Interfere with or disrupt the App, our servers, or any other user's experience.
Use the App to harass, threaten, or harm any person.
Resell, sublicense, or commercially redistribute the App or access to it, except as expressly permitted.

We may suspend or terminate accounts that violate these rules.

5. Subscriptions and Payments

5.1 Free and Paid Plans

Elevate Stats is offered with a free tier and one or more paid tiers ("Pro"). Paid tiers are billed monthly or annually in Canadian dollars, as shown at checkout.

5.2 Free Trial

From time to time, we may offer a free trial of Pro features. Any limits on trial usage (such as a maximum number of tracked games) will be shown in the App. Trials automatically end when their limits are reached.

5.3 Billing

Paid subscriptions are processed by Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis for the applicable fee until you cancel. You are responsible for keeping your payment details up to date.

5.4 Renewals and Cancellation

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from the App or by contacting us. When you cancel, you will keep access to Pro features until the end of your current billing period.

5.5 Refunds

Subscriptions are non-refundable. Cancelling stops future charges but does not refund the current period.

5.6 Price Changes

We may change our prices from time to time. If we do, we will notify you in advance, and the new price will take effect at your next renewal. If you do not agree, you may cancel before the new price applies.

6. AI Insights

The App offers AI-generated written insights based on your team's game data. These insights are produced by third-party AI service providers and are provided for informational purposes only.

You acknowledge that:

AI-generated content may contain errors, omissions, or misleading statements.
Insights are not a substitute for professional coaching judgment, medical advice, or player development guidance.
Elevate Sports Labs makes no warranty as to the accuracy, completeness, or usefulness of AI-generated content.

How we handle data sent to AI providers is described in our Privacy Policy.

7. Offline Use and Data Sync

Elevate Stats is designed to work in arena environments where internet connectivity may be unreliable. The App stores a copy of recent game data in your browser's local storage so you can continue tracking offline. When your connection returns, the App syncs that data to our servers.

You acknowledge that:

Offline data is stored on your device until it successfully syncs.
Clearing your browser data, uninstalling the App, or using a different device before sync completes may result in the loss of unsynced data.
We are not responsible for data lost due to device-side actions before a successful sync.

8. Service Availability

We work to keep the App available and reliable, but we do not guarantee uninterrupted service. The App may be unavailable from time to time due to maintenance, updates, outages, or circumstances outside our control.

We are not liable for any loss resulting from service interruptions, including missed game-tracking opportunities.

9. Our Intellectual Property

Elevate Stats, including its code, design, logos, branding, written content, and AI-generated output (excluding Your Data), is owned by Elevate Sports Labs Inc. or its licensors and is protected by Canadian and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal or internal team use while your account is active and in good standing. All other rights are reserved.

You may not copy, modify, distribute, publicly display, or create derivative works from any part of Elevate Stats without our written permission.

10. Termination

10.1 By You

You may stop using the App at any time. You may request deletion of your account by emailing privacy@elevatesportslabs.com.

10.2 By Us

We may suspend or terminate your account if:

You breach these Terms.
Your use of the App creates a legal, security, or operational risk for us or other users.
We discontinue the App or a specific tier of the App.

If we terminate your account for reasons other than a breach by you, we will give reasonable notice where practical.

10.3 Effect of Termination

On termination, your right to use the App ends. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.

11. Disclaimers

ELEVATE STATS IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATE SPORTS LABS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION.

We do not warrant that Elevate Stats will meet your requirements, that it will be error-free, or that any defects will be corrected.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVATE SPORTS LABS INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF ELEVATE STATS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR ELEVATE STATS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY CANADIAN DOLLARS (CAD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Elevate Sports Labs Inc. and its directors, officers, employees, and contractors from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of:

Your use of Elevate Stats.
Your breach of these Terms.
Your infringement of any third party's rights, including privacy rights of minors whose information you entered into the App without appropriate authority.

14. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or Elevate Stats will be resolved in the courts of Ontario, Canada, and you consent to the exclusive jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will show when they were last revised. If we make material changes, we will notify you in the App, by email, or through the Site.

Continuing to use Elevate Stats after an update means you accept the revised Terms. If you do not agree, you must stop using the App.

16. General

Entire agreement. These Terms, together with the Privacy Policy, form the entire agreement between you and Elevate Sports Labs Inc. regarding Elevate Stats.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
No waiver. Our failure to enforce any provision does not waive our right to enforce it later.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
